By accessing FitverseHub ("we," "us," "our"), you accept and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the services.
2. Medical Disclaimer
FitverseHub is NOT a medical provider. The nutritional data, workout plans, and health insights are generated by AI and are for informational purposes only. They do not constitute medical advice, diagnosis, or treatment. You assume full responsibility for your health decisions. Always consult a physician before beginning any fitness or nutrition program.
3. AI Services
Our app utilizes third-party artificial intelligence services (Gemini). While we strive for accuracy, AI models can produce incorrect or misleading output ("hallucinations"). We do not guarantee the accuracy, completeness, or usefulness of AI-generated content.
4. Subscription & Billing
Subscriptions are billed on a recurring basis. You may cancel at any time via your device's app store settings. Cancellations take effect at the end of the current billing cycle. We do not provide refunds for partial months or unused time.
5. Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT SHALL SCALETECH SRL, ITS DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $50.00 USD OR (B) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
6. Binding Arbitration & Class Action Waiver
Applicable to US/Canada Users: Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. You agree that you may bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Governing Law: For all other users, these Terms are governed by the laws of Romania, and any disputes shall be subject to the exclusive jurisdiction of the courts of Brașov, Romania.
